As consideration for the service(s), you agree to:-

We rely on this information to send you important information and notices regarding your account and our services. In particular you agree that if you fail to notify us of any change of address within four weeks of your change of your address then we have the right to terminate your contract with forthwith without notice to you.

Right to Amend Terms and Conditions
We reserve the right to change these Terms and Conditions at any time. The Terms and Conditions that are displayed on the site at the time you are using it are those which shall apply to you, the changes come into effect when they are posted on the web site. It is advised that you check the Terms and Conditions from time to time. The last date of change will be displayed at the bottom of the Terms and Conditions page.

Our web site is used by people of all ages and backgrounds and we aim to maintain a site free from any offensive or illegal content. All content on this site is the property of Freedom Web Services except those from third parties, all third party content on this site remains the property of that third party.

All services provided by Freedom Web Services may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of UK and international law is prohibited. This includes, but is not limited to; copyrighted material, material we judge to be threatening or obscene, unlicensed software or files, or material protected by trade secret and other statue. The subscriber agrees to indemnify and hold harmless Freedom Web Services from any claims resulting from the use of the service which damages the subscriber or any other party. Examples of non-acceptable content or links

  • Pirated software
  • Illegal MP3's
  • Hackers programs or archives
  • Warez Sites
  • Pornography of any kind

Freedom Web Services will be the sole arbiter as to what constitutes a violation of this provision.

Chat Rooms
We do allow clients to install their own chat rooms. However, these tend to be large system hogs and may fall into the usage limitations clause. We do provide an html based cgi chat room that runs without hindering the performance of the machine for others. You are free to run your own chat script, as long as it does not hinder server performance.

Cron Jobs
We do allow Cron Jobs to be conducted on our servers.

IRC
Freedom Web Services currently does not allow IRC or IRC bots to be operated on our network.

Multiple Connections
Multiple telnet and ftp sessions are allowed, on a single hosting account.

Idle Timeouts
We reserve the right to disconnect any idle connection to the network.
Average timeouts are:
FTP - 300 seconds
Telnet - 2 hours

Background Processes/Programs
We may allow programs to run continually in the background, these are considered on a one to one basis and a extra charge may be incurred based on system resources used and operational maintenance needed.

Commercial Advertising - Email
Spamming, or the sending of unsolicited email, from a Freedom Web Services. servers or using an email address that is maintained on a Freedom Web Services machine is STRICTLY prohibited. For general reference, we consider spam any email that is sent to more than 10 people at a time that did not ask for it to be sent to them. Freedom Web Services will be the sole arbiter as to what constitutes a violation of this provision. Opt-In email is acceptable, as long as Opt-Out/Removal requests are fully honoured. Please make an effort to limit outgoing mail on your account to no more than 1000 pieces per DAY and no more than 20 pieces per minute. Many times we have seen sites push over 1000 emails in one hit, this causes extreme server loads and prevents other people from accessing server services. Large mailings are preferred to be sent from the hours of 0500 - 1300 GMT. Sites with large mailing databases, need to be placed on dedicated server platform. Please contact us if you have large email requirements. Zero Tolerance for Spam Freedom Web Services will not tolerate any spamming by any of its Customers. This prohibition of spam extends to the sending of unsolicited mass mailings from another service, which in any way implicates the use of Freedom's services whether or not the message actually originated from our network. Violation of this NO-SPAM policy will result in Freedom Web Services taking one or more of the following actions:

  • Suspension or cancellation of your site/hosting account until further notice
  • Removal of DNS for the advertised/originating site
  • Temporarily blocking outgoing mail from your site
  • Repeated violation of this NO-SPAM policy will result in immediate disconnection of service with no re-activation
  • A warning via e-mail or telephone

We reserve the right to take all legal and technical steps available to prevent unsolicited bulk e-mail or other unauthorized e-mail from being sent from or transmitted through the Freedom Web Services Network. There will be NO REFUND given for spamming.

Bandwidth
Each hosting package has a limitation on bandwidth. It is the customers responsibility to ensure that their monthly bandwidth quota is not exceeded.

Server Abuse
Any attempts to undermine or cause harm to any of our servers is strictly prohibited. Freedom Web Services will pursue legal action to the fullest extent for all abuse of the Freedom Web Services Network

There are links on this web site to other independent web sites. Freedom Web Services cannot be held responsible for any content held on these third party web sites.

Availability
All products and services shown on the web site are available to the best of our knowledge. Web site hosting accounts are available 24 hours except when the server is shut down for maintenance. If this is the case when you are purchasing hosting then the account will be set up as soon as is possible. Server uptime is 99.9% and is only shut down when absolutely necessary. The server is owned by a third party and as such Freedom Web Services have limited control over it. We are in direct contact with the company whom leases the server and can resolve problems quickly. Domain names can not be guaranteed available even if a search shows them as being available. Due to the nature of DNS it is possible for a domain name showing as available even though it has been registered by another person. This is due to the DNS being queried not being updated at the time the query was made. If this occurs then Freedom Web Services will either arrange for an alternative domain name to be registered or a refund for the domains names not registered will be given. ALL FEES ARE NON-REFUNDABLE , IN WHOLE OR IN PART, EVEN IF YOUR SERVICE IS SUSPENDED, CANCELLED OR TRANSFERRED PRIOR TO THE END OF THE THEN-CURRENT SERVICE TERM. We reserve the right to change fees, surcharges, renewal fees or to institute new fees at any time, for any reason, at our discretion, without prior notice to you.

Product Descriptions
Freedom Web Services with an accurate description of themselves, their work and any specific products and services displayed on the web site. If customers want any more details about a particular product or service they are free to contact us for any additional information. Purchases All purchases made from this web site will be subject to these Terms and Conditions. You must accept these Terms and Conditions before making any purchase from this web site. All prices displayed on this web site are in £ sterling, as we are a small company there is currently no VAT added. Credit card details taken via PayPal through a 128 bit SSL secure server to provide the safest way to shop on the internet. These payments are also subject to Paypal's User Agreement. Paypal currently accept payments from Visa, Master card, PayPal Credit Card, American Express, Switch, Solo, Visa Delta and Visa Electron. You do not need to have or set up a paypal account in order to purchase from this site. Payment by cheque are accepted but no products or services will be activated until payment is cleared. Be warned that due to the time taken for a cheque to clear any domain names purchased may no longer be available after payment clearance. If this happens the customer will be either offered alternative domain names or be given a refund for the domain names not registered.

Contract
When you go through our checkout requesting to purchase a product or service is taken as an offer to buy, subject to the acceptance by Freedom Web Services. We reserve the right to refuse any offer to buy by a customer. A contract will not be formed until we contact the customer confirming our acceptance of your offer to buy. At this point a binding contract will be formed between Freedom Web Services and the customer. Under exceptional circumstances Freedom Web Services reserves the right to rescind any contract and will refund any monies taken, putting each party back to the position they were in before the contract was formed. Hosting accounts are subject to a 12 month contract, paid in advance, and can only be cancelled within a 30 day period after the initial purchase is made. Renewal notice will be given approximately 60 days before the end of the 12 month contract, it is the responsibility of the customer to ensure that the payment for the following year is made before the end of the current contract. Any accounts not paid within these 60 days and will be suspended and eventually deleted some time after this at our discretion. All hosting accounts are subject to our terms of misuse and the contract can be canceled by Freedom Web Services with out any refund if found to be misused. Domain names can be purchased for 1 or 2 years depending on the domain name purchased. All payments must be cleared before any domain names are registered. The customer can if they wish transfer any of their domain names to another domain name registrar. This will be done free of charge unless the customer has had their hosting shut down due to misuse, in this case there will be a £25.00 administration charge

Cancellations
If a customer wishes to cancel an order for any reason after payment has been made then a full refund will be given for any hosting package purchased. No refunds can be given after 30 days of activation of the hosting account. We regret that domain names refunds can only be given if the domain name has NOT been registered.

Data Protection
All information taken by Freedom Web Services is strictly confidential and will not be shared with any third party. We will only use any information collected about you in accordance with the Data Protection Act 1998. Information collected about you includes, name, address, phone number, email and address. The information collected will be used to process your order accurately and may be used to inform you of any offers or news from Freedom Web Services. It will not be used to inform you of any offers from any third parties except businesses related to Freedom Web Services. If you do not wish to hear from Freedom Web Services, you will be given the option to unsubscribe from this. You can update any information we hold on you at anytime by contacting us with any amendments.
